Pursuing a PCP commission claim through the courts isn’t right for everyone, but for some consumers, it can result in a significantly better outcome than alternative routes. This case study examines one such example.

Background

In 2023, we began representing a client who had entered into a Personal Contract Purchase (PCP) agreement with a major vehicle finance provider. Like many consumers, our client was unaware that the dealership and finance company had received substantial commission from their car finance agreement – commission that was never disclosed at the point of sale.

This lack of transparency is at the heart of thousands of PCP commission claims across the UK. When commission arrangements create conflicts of interest and aren’t properly disclosed, consumers may have grounds to seek redress.

Why This PCP Claim Went to Court

After investigating the circumstances of the agreement, we determined that pursuing the claim through the courts could be beneficial for our client. The case proceeded to a final hearing, where both parties presented their evidence and arguments before a judge.

Court proceedings require:

  • Thorough preparation and detailed evidence gathering
  • Witness testimony from the claimant
  • Legal representation from experienced solicitors and barristers
  • Clear presentation of facts and documentary evidence

Our client attended the hearing to provide their witness statement – an experience that can understandably cause anxiety for anyone unfamiliar with court procedures.

The Court’s Decision

Following the final hearing, the court ruled in our client’s favour.

The award included:

  • £1,825.82 in full undisclosed commission
  • 8% statutory interest on the commission amount
  • Total award: approximately £2,669.99

(This figure is before deduction of any legal fees or costs, which may reduce the amount ultimately received by the client)

For comparison: Had this case been resolved under the proposed FCA redress scheme instead, the total redress (calculated up to 31 December 2025) could have been £1,108.00.

This demonstrates that court action can result in higher recovery in some cases, though it’s important to note that outcomes always depend on individual circumstances and the specific facts of each case.

Our Client’s Experience In Their Words

Court proceedings can feel daunting, especially if you’ve never been involved in legal action before. Our client shared their experience of working with our team throughout the three-year process:
