Background
In 2023, we began representing a client who had entered into a Personal Contract Purchase (PCP) agreement with a major vehicle finance provider. Like many consumers, our client was unaware that the dealership and finance company had received substantial commission from their car finance agreement – commission that was never disclosed at the point of sale.

Why This PCP Claim Went to Court
After investigating the circumstances of the agreement, we determined that pursuing the claim through the courts could be beneficial for our client. The case proceeded to a final hearing, where both parties presented their evidence and arguments before a judge.

The Court’s Decision
Following the final hearing, the court ruled in our client’s favour.
The award included:
- £1,825.82 in full undisclosed commission
- 8% statutory interest on the commission amount
- Total award: approximately £2,669.99

For comparison: Had this case been resolved under the proposed FCA redress scheme instead, the total redress (calculated up to 31 December 2025) could have been £1,108.00.
This demonstrates that court action can result in higher recovery in some cases, though it’s important to note that outcomes always depend on individual circumstances and the specific facts of each case.
